SIGNS OF DESPERATION

       I have been granted special leave to appeal against the decision of the High Court of Kerala at Ernakulam in their OP (C) No.1819 of 2014.

       you can find this impugned judgement on the net at this web address. Looking at it in isolation it looks sober; but I can assure you it is fatally flawed.

      I have not touched the real delicate points in the SLP – I was playing it safe.

      Now that the SLP has been converted into an Appeal Civil thanks to the kindness of the apex court ( I really mean it and am not just using formal language ) I have this chance to file a statement of case where I can put things in the proper perspective and tear away the facade.

     People are real worried - I can feel their pulse and I see signs of desperation; they are going to cut a very sorry figure indeed !

        The only way out for them is to see that I am not there to present the case and desperate attempts are on to neutralize me one way or the other. And the easiest way in my case is to recruit a “relative” !

I DO NOT CARE.

       ( incidentally google was telling me that my location is chennai – my pass word has been changed from chennai ! I am not at all surprised.

              while I pass through chennai en route new delhi, very frequently  now a days, I have to spend 12 hours on the platform waiting for the connecting train; and I did notice  highly intelligent teenagers discussing all sorts of great things sitting behind me. it is a ruddy disgrace – if you want to get noticed try streaking.

                People on the look out for property at throw away price had gone back empty handed after they saw me present in my shack when they had come to make the purchase. I was not expected to be back from my last delhi trip that early.    It is very much possible that when I come back from my next trip – I am scheduled to leave on 20160419 – my humble abode is already occupied by broiler chicken.

               People on casual visit are looking up my old four wheeler and assessing how cheap it is going to be.

              Enfield is in high demand and has already been “sold” out. 
              Now   what is it that you are interested in? pay a visit while i am not here - the pimps have duplicates of all my keys.  come and grab it before it is gone   )

        My real problem is my lazy self. even after all these days i have not started working on the statement of case all these days. 
      the problem is to get started;  once i do that I can finish it in a jiffy for I am thorough with the matter and have already planned every thing and have just got to put it in paper.

      By the way, my 4G mobile wiFi is still working ! After a very long interval I downloaded a few bbc podcsts and it was done in a matter of seconds. The device is basically meant for mobile phones and could be the speed of down loading is the real thing as far as this thing is concerned.

       I do not have a smart phone and am using it on my good old note book PC and I was not impressed by the browsing speed.

     What you find below is a rather distorted copy of a communication I had receieved from the secretary of karakulam grama panchayath. 

           the notice says that the matter of illegal construction and atmospheric pollution will be decided at the lok adalath being held under the auspices of the dt. judge Thiruvananthapuram at the panchayath office on august 23, 2013 and 

           if I am not present on the stipulated date the case will be decided ex-parte.

           I remember  that this was delivered to me on august 18, 2013. 

         I had planned a trip to new delhi in august 2013 and would have been in the train on that day had I not postponed the trip at the last moment. That way I would have missed the communication and the matter would have been decieded against me. I reached the panchayath office very much in time.

So that strategy did not work. 

         How can the panchayath secretary contradict the order of the lok adalath, that too, when the panchayath itself had referred the case to the lok adalath for decision ?

       Well that is what the opposite party's lawyer has been harping on at the execution petition till date.

        It was all verbal and I am waiting for the written version but that is being postponed time and again with the opposite party's counsel “NOT READY”.

        Last time the counsel was directed to file it on the last working day before the vacation and the case was adjourned till the end of the summer vacation – that is end may 2014.

        I had been to the court on the last working day before the vacation that is April 11, 2014, to collect my copy. As expected it has not been filed.

              Yes; I had filed an execution petition with the “appropriate authority”.

           And for  the first time in my life, I had been to a court of the subordinate judiciary. The practice here is different from the courts of the higher judiciary but I am gradually getting used to it in the bargain making a few minor mistakes here and there.

         As is usual with almost all cases involving me, the opposite party is desperately expecting their masters to keep their promise, on the strength of which they had done the dirty on me.

          Hence the request for postponements time and again expecting that at the next hearing I wont be there to plead my case.

          And there is a huge hue and cry going on all around. The places I visit are swarming with goondas ( and their feminine genders ).

          I am keeping my cool. Ultimately the gestapo will have to face me and then we will see what can be done about it. I am in no hurry.

i WILL try to cross the bridge when I come to it.

Right now I am making an effort to get the address in my driving license and the vehicle registration certificates changed to my present home address.

And I had a good look at my photograph in the present license taken in 2009. The physical degeneration is drastic.

What could be the reason for this very remarkable change in my appearance in the last few years ?

The fact of the matter is that over those years I was being “licked” by the Indian peppatti.

The Indian peppatti licked away the flesh leaving the skin and bones and i became a bag of bones. The flesh accumulated on the peppattees' big paunches.

Peppatti means a rabid dog - the hindi equivalent is pagal kutha.

The Indian peppatti is a protected variety and the tax payers money is lavished on them through the unaudited funds made available to them in the name of paying their pimps for gathering “intelligence” .

The word “intelligence” here is used as when you call faeces, jelebi.

I brought a mobile phone- the situation here is that if you do not have a mobile number you do not exist.

Till recently I had a mobile number – the internet modem that I had could double up as a phone as well and it has a valid mobile number. The charm of it is that it was just a number only; I will not have to attend the phone for except when connected to my puter the reply you get will be that the phone has been switched off.

Even now you can try that number +91-9349558387 and you will get a some what similar response for once it was stolen I got the company to block it with some difficulty for you have to produce the very same papers of identity that you had shown at the time of getting that connection.

I thought once I get another wireless usb I can still continue similarly. But the device I now have is a simple wireless internet connection and there is no phone number – yes I brought a wireless internet connection as well and about that later in this write up.

So I ultimately went in for a cell phone connection; and the miser that I am I went for the cheapest hand set. This one shown below comes for 1290 INR and along with the cost of the simcard and the initial prepaid call card it comes to 1400 INR.

But even this handset I find has too many gadgets; who is going to use the internet on this miniscule thing ? NOT me! what I wanted was a simple one.

   

I have never used a cell phone and am gradually coming to grips with it.

And indeed it was not a smooth affair getting a connection for a person of my notoriety; there were stumbling blocks ( man made ) and it took four days to make my first call that is even after making the payment.

                                Well it is working, at least for the time being.

USING THE INTERNET,  
FOR ONCE  IN Nedu !

The new net connection is a positive asset. You see I am regularly getting a down load speed around one mb and it can even go to 1.5 mb.

So I have started downloading bbc podcasts again and am getting connected to the civilised world once more. I dont have to waste my time while I am cooking and I have got my spare speakers in the anteroom so that I can listen to something at the same time as I do the cooking.

Another fact is that the isp has given 10 GB extra download in the initial month and you cannot blame me if I am tempted – you see I have to use it up before the month end ( and then of course I will have to pay 150 for the next 750MB ). so I am trying to make hay; but the problem is that YP once in a while says that they are undergoing maintainance – what a pity.

So I do have compnay now a days and things are really looking brighter.

addendum 20140322: 

 in deed! yesterday (20140321) morning hours i down loaded one gb ( i still have  4Gb of the total 10 GB freebee from the isp) and the speed shot up to 2MB per second. that is tremendous. 
usually i just down load the youPorn movies i fancy; but this time i was watching and * # $ %  and simultaneously downloading. ( please do NOT tell anybody ) but that is till march 27 when the free allowance expires. under normal rates it is a rather costly affair which i cannot afford.
by the way i got down 250 mb of bbc podcasts as well. and i do lizten to them mostly when i do the cooking and the house hold chored - there is an extension speaker in the anteroom.

MAKING THE BEST OF A BAD SITUATION   

The KuB antenna has conked off but I have the songs that I had captured on to my computer my choice ones.

The bsnl broad had been dead for the last whole week and still is dead – who cares!

It is a sunday and I had been at home all through, for that matter I did not go out yesterday also and indeed for the first time brought some milk eggs and bananas from a local shop rather than make a trip to Trivandrum or perurkada.

There is going to be some fun tomorrow and I have to get ready and am going to call it a day with the puter for the time being

Today again I had been to the city and this time again I chose to go by public transport. And there, as long as you avoid the peak hours and you can take your own time and wait for a bus where you can manage a seat there is not much of a problem. That way I choose to get in from the terminuses and it helps.

Well; my purpose was to get a cell phone for my land line is still dead and I wanted to get even with the “gentry” . The reliance staff here are not my friends either. Usually once you buy a connection it gets activated within 24 hours as per the company's norms; but I have been told that it might take three days to activate it.

Well; the most likely scenario is that the staff here will not upload the files to their headquarters during the next two days. There is nothing much I can do about it.

The fact of the matter is that within the next two days “kayamath aayega” -  a highly knowledgeable philosopher of the area and his disciples have given me two choices -  either spend the rest of your life in jail or in a mental asylum; the choice is mine!

that way there is no disagreement on the matter amongst the locals. "nammakku ithu vittukittunna kashu kondu matteviteyengilum poyi oru veetu vangi thamasikkam" that was a shubh chinthak of mine.

incidentally i had been living here for about two and a half years. after my arrival a family had started living here in a nearby  house they had brought. Now a days i find that they are no more here.  i am told they had sold the house and left. They obviously they had come with the idea of settling here and could be that they found the place uncongenial.

a young man whom i know casually i found was building a house on the other side of the road. i was wondering why this fellow when he could have got a better place and in a far more comfortable situation on this side of the road - and in my foolishness i even asked him why not?  he did not say anything.
later on it occurred to me that it could be that segregation of some sort is still being practised here even now; like which all people can stay where all. or  it may even be that you yourself are aware that  you cannot  feel at homeat certain places.

          yeh sub much jaise phudhuom ko kaise samajh men aayega ? !

To day in the evening I found that the my Ku band free DTH is not working – NO SIGNAL. There is no way I can find out whether the whole satellite has been hijacked or it was just a minor tampering with my dish antenna. Let us see.

The land line phone is just hanging on the wall in front of me silently. 
The letter has already been delivered to the pgm this evening. It is a speed post letter and here is the track report.

This time there is no ambiguity and the letter has really been delivered.

So all out side connection has been cut off; but the internet is functioning and the download is not bad as far as my experience is concerned for it is the first time I have seen the internet connection crossing one mb per sec! And in deed I downloaded two or three bbc podcasts some time back and it took only one minute to down load a 12mb podcast and in practice it is a real good speed, as far as my experience is concerned. video streaming and all still is a problem.

                an interesting feature is the date of a local news paper that is being loaded on my looking up the latest news -

 initially it was the jan15 news and later it became feb 06. also when i had reinstalled a win xp and started browsing the default home page chosen by the browser some thing i had used long back before this hdd was formatted and which i did not have on the system.

My water purifier is working in spite of the fact that it had some initial problems and in spite of the fact that I could not get the service representative here. The actual problem was that some mischief monger had loosened a screw at the bottom and that was the reason for the leak. I tightened it and it is functioning fine now and the water is wholesome and I enjoy drinking lots and lots of cold water especially with the hot weather over here. When I had to purchase packaged water I used to severely restrict the water intake the miser that I am.

I have noticed a technical snag in my blogs – see I have started liking a particular font Tempus Sans ITC and I am using it in almost all my documents. But the problem is that it is not a very common font and most other computers my blogs appear awkward aestheically. So now a days I am changing my blog into one of the common fonts Georgia

             now a days if you dont have a cell phone you do not exist. I could manage earlier as the usb wireless modem could double up as a cell phone as well and the charm was that I could get SMS at cheap rates and even free and the best thing was that I wont have to take the calls for it comes on line only when I connect it to the computer and will say that I have switched off. Sms on the other hand will be saved on the server and once I connect to the puter it will be delivered. I really miss that device.

Respected Sir,

I found my home telephone no. 472-2802028 dead at about 2000hrs on 20140301 and the above phone was still dead when I left my home at 1200hrs noon on 20140302 (that is today).

PAST HISTORY

Sometime in early January 2014 I had lodged a complaint with the telecom authorities about the non-functioning of the ADSL facility on the above land line.

The claim of the sde nedumangad bsnl on the matter as he spoke to the sde cto on the phone was that

1. the problem was with the faulty line,
2. They had checked and cleared the line up to the DP and there was no problem in that section
3. So the problem must be with the section of the wire from the DP to the telephone instrument inside the house.
4. The staff are not able to clear the above portion as the customer, that is me, is not allowing his staff to enter the house and repair it.

I ignored the above statement and realizing that there is no point in my trying to reason with your staff, left things alone.

Since then, that is from early January to February 28, 2014, I have not made a single call from the above telephone and had left the thing alone – I was all through paying the bill. and i never even tried the adsl internet during  that period.

Some time in mid February I had noticed that the line has become clear and there was no noise any more.

I wonder how this could have happened as according to the sde the fault was with the internal wiring and "I have NOT ALLOWED any one to enter the house"  from then on as well. The reason will be obvious to any sensible human being.

I left the telephone at it for I knew that once I start using the telephone, it will be made noisy again.

All the same, on march 01, 2014 I started using the phone again and made a few calls. Every thing was smooth and I got through to a home appliance service people who agree to come and attend to my equipment within 48 hours after ringing me up on the above telephone of mine.

I left the house in the evening on a trip to Trivandrum and when I returned at around 2000hr s in the night I found that the phone was dead.

And as I mentioned earlier it was still dead when I left my home today 20140302 at 1200 hrs.

AM I SURPRISED ? NOT AT ALL.

ADDENDUM

the fact of the matter is that I am living in 4 x 5 sq. meter structure. 

The telephone is in the room that I use as bed room which forms 4 x 3 sq. meters contains almost all my stuff and there is no space even to turn around. 

So when their staff member who routinely comes I used to take the instrument with the attached cable in situ to him in the anteroom ( which forms the remaining 4 x 2 sq. meters and accommodates my gas stove, fridge, washing machine and that way is not very cosy). 

And in deed I used to ask him whether he has to come into the “bed room” proper and he used to answer there is no need and he used to check it and satisfy himself that all is fine.

If he had told me that he would want to check the instrument inside the inner room I would not have refused; but he never said that. 

And also it does not make any difference of any sort for all that is missing is the cable going through the four inch single brick into the inner room

and if at all there was a problem how could it have repaired itself on its own as is obvious from a movie i have put on net in the previous blog in this series!
